RS 9:242

§242.  Waiver of delay

A.  A judge or justice of the peace authorized to perform the marriage may waive the seventy-two-hour delay upon application of the parties giving serious and meritorious reasons.  His certificate authorizing the immediate performance of the ceremony must be attached to the marriage license.

B.  Notwithstanding the provisions of R.S. 9:241, an officiant authorized to perform marriage ceremonies in the parish of Orleans may waive the seventy-two-hour delay for nonresident parties upon application of the parties giving serious and meritorious reasons.  His certificate authorizing the immediate performance of the ceremony shall be attached to the marriage license.  For purposes of this Subsection, "nonresident" shall mean a person domiciled or residing in a jurisdiction other than the state of Louisiana.

In June of 2003 Gov. Foster signed my bill SB565, From the time I started until done less the 4 months.  Did not know a US citizen could change law!  A great feeling!

The cost of a Louisiana marriage license, purchased in Orleans Parish, is  $27.50 which is payable to the State of Louisiana.
($12.50 of this goes to the domestic violence fund in the parish where the license is purchased)

Certified copies of your marriage license may be purchased at the same time for $5.00 each.
We recommend 2 certified copies.

Credit cards are NOT accepted

You must:
always have a valid picture I.D.
(drivers license, military ID, or passport)
have the original or a certified copy of your birth certificate.
Have your SS card is best but knowing your social security  number.  Know both parties mother's maiden names.

For your convenience we have posted it so you will know what information you will need to provide. Louisiana Revised Statute 1:55 declares days of public rest and legal holidays.
 
* Inauguration Day is a holiday in the City of Baton Rouge once every four years, and Memorial Day shall be annually proclaimed as a legal holiday as specified in R.S.1.55. General Election Day is a state holiday the first Tuesday after the first Monday in November in even-numbered years.

Getting married in New Orleans is very simple.
Below is a detailed outline of all the information you need to know to get married in one of the world's most romantic cities!

  • A birth certificate or certified copy of your birth certificate is required if you were born in Louisiana.   If you were not born in Louisiana, you can get a waiver for it on weekdays.  If applying on Saturday you must have the birth certificate or a certified copy of the birth certificate.  

  • Waivers are only available for birth certificates Monday through Friday.

  • You should have your social security card, or just your number. If you do not have your card or do not know your number, the licensing issuing agent at the marriage licensing bureau can sign the social security waiver.
  • For Internationals who do not have social security numbers, your passport is sufficient.  The licensing issuing agent can sign your waiver for the social security number.
  • Waivers are obtained by asking for them. You will be sent across the street to the Municipal building where a judge will sign the waivers for the birth certificate.  We do recommend that if you have your birth certificate, bring it to cut down on the time factor.
  • As of a licensing revision 5/20/05,  If you are widowed or have been divorced, you must have a certified copy of the death certificate or divorce decree to obtain a license. 
  • There is still a 72 hour waiting period in the state of Louisiana.
    However, our Reverends can sign this waiver allowing you to be married any time after having your marriage license issued.   This change, allowing an officiate of Orleans Parish ONLY to sign the 72 hour waiting period waiver, was adopted in June of 2003.  This applies to non-residents ONLY.  For Louisiana residents, you MUST have the judge sign the 72 hour waiting period waiver.  Resident  waivers can only be obtained Monday-Friday. Licenses are good for 30 days following issuance.
  • Only one of you need apply, please bring all information, and documents with you. You must also know both parties mother's maiden names.
  • This will take from 30 minutes to 1 1/2 hours and cost is $27.50 ($12.50 of this goes to the domestic violence fund in the parish where the license is purchased)
